emoscene.com does not charge for any of its services. community members must be 14 years or older. emoscene.com is fully financed by advertisements and merchandise sales.

disclaimer of warranty

emoscene.com shall not be liable for any damages emerging of using our services. therefore users are bound to exempt emoscene.com from any claims for liability.

emoscene.com expressly dissociates from contents of any third party web services or similar which are directly or indirectly linked from our pages. emoscene.com shall not be liable for any contents of these sites but the third party owners or providers are themselves.

liability of the users

every user is liable to the full extent for the data (e.g. texts, images, sounds,...) the user publishes on our pages. every user agrees, that she or he will publish no data which is incorrect in substance, defamatory, libelous, pestering, pornographic, violence glorifying, threatening or racist and the data does not violate applicable law (i.a. copyrights).
furthermore it is forbidden to use our services for commercial aims or advertisement (spam) without our agreement. sole exception from this is the advertisement forum.
all users are bound not to collect, use or process improperly completly or partially any of the data or techniques emoscene.com provides or its source code and not to pass or sale any of it to any third party.

privacy

all data users publish on emoscene.com is only made available for other users of emoscene.com and not for any third party. a users date of birth is hidden for other users, only her or his hence calculated age can be shown to the users.
also email addresses can not be seen by other users and it is only used to send a confirmation mail or to get in contact with the user if there was any further inquiries, which means emphatically no advertisement.
mails which community users send can only be seen by the involved two parties. members of the team of emoscene.com will only check such mails in exceptional case (e.g. to confirm an accusation of defamation) and with the agreement of the receiver.
to all published data, emoscene.com will save the ip address of the publishing user and the exact time of publishing. these data will be used for internal statistics. only in cases of violating these terms of use or contraventions, the data could be passed to authorities or court of justice to identify the responsible person.

noncompliances

in cases of violating the terms of use or contraventions users can be excluded from using our services, especially the community, without giving a notice or keeping a term. we reserve to take legal proceedings, if necessary.

final clause

if any parts of these terms should be or will get invalid, so it does not affect the remaining terms.
